Why in the News?

The Subordinate Legislation Committee of Rajya Sabha has pulled up the Union Government for the delay in framing of rules/ regulations for the Acts passed by Parliament.

What are the Key Findings of the Committee?

1) The Executive’s duty is to frame rules within six months of passing an Act. However, various Ministries have been consistently delaying this process. For example, despite the National Food Security Act (NFSA) being in force for ten years, rule-making processes in Delhi, Rajasthan, and Uttarakhand are pending.

2) The delay in framing rules defeats the purpose of Acts as they cannot be implemented without these rules.

What is the Committee on Subordinate Legislation of Rajya Sabha?

1) Rajya Sabha Committee on Subordinate Legislation was first constituted in 1964.

2) Mandate: To scrutinize and report to the Rajya Sabha whether the delegated powers to make Rules, Regulations, Bye-laws, Schemes and other statutory instruments, given to the Executive by the Parliament is being properly exercised.

3) Composition: The Committee consists of fifteen members. The Chairman is nominated by the Chairman of Rajya Sabha.

4) Term: The Committee holds office until a new Committee is nominated. Normally, the Committee is reconstituted every year.
