What are the reasons behind the overcrowding of prisons in India? State the measures that are required to handle the overcrowding.

Excellent answer! You can add that investigation function must be separated from general law, overburdened police means delay in investigation, leading to long trial period. Proportion of under-trials > 70%. The SC has also said that those under-trials who have served half of the jail term for the crime they are accused of, should be released.

about the last point you mentioned: i thought not to add it as SC recommended so on the occasion of 75th independence only, not a long term solution i guess!!?
The debate regarding this has been going on for long, SC had suggested it in 2014, refer the link article. It has been prescribed under Sec 436A of CrPC

Great answer! Also add issue of lack of awareness. You can mention > 75% under-trials. Suggestions are good. Add separation of law and order and investigation functions of police forces.

Excellent answer! Mention the need to separate investigation and law and order functions of police, it can speed up investigation and trial process. The SC has asked the Govt. to release under-trials who have already served half their sentence for the crime they are accused of. You can also quote some committees related to police and prison reforms.
Good answer! Add 1-2 explanatory lines in some arguments e.g., explain lack of bail law and jail as norm, SC remarked ‘bail not jail’ as norm.
COVID-19 is not a major reason for pendency, it has only added a little more to the existing problem.
Also mention lack of knowledge and access to legal aid due to poverty.
In suggestions, you can add reference of some Committees/Commissions related to prison and police reforms.

There is deviation from the core issue. Overcrowding is largely due to high proportion of under-trials, and denial of bail (jail is norm). There is also lack of access to legal aid for the poor. You need to discuss these issue and suggest measures accordingly. Infrastructure etc. are peripheral issues here and shouldn’t be given prominence.
