The Focus Article of EPIC August 2024 covers the Supreme Court’s Judgment on Sub-classification of SCs/STs. A 7 Judge Constitutional Bench of the Supreme Court has allowed the States to sub-classify the SC and ST communities. The Apex Court has thus overturned its 2004 Judgment when it had held that all SCs must be treated identically. The Judgment has opened ground for States to better target the benefits of reservation towards the most disadvantaged communities among the SCs/STs. However, the Supreme Court has given a caveat that the reservation must be based on quantifiable and demonstrable data and the affirmative action policies must be empirically determined. Thus the Supreme Court has made an effort to limit the exploitation of its Judgment (and the reservation policies) for political purposes.
