Model Code of Conduct to apply immediately after premature dissolution of House: EC

News:

  1. Model code of Conduct to come into effect immediately after premature dissolution of Legislative Assembly.

Important Facts:

  1. Until now, the model code of conduct was applicable only with announcement of poll schedule by the Election Commission.
  2. Caretaker government has been asked to carry on the administration of that state or Union Territory for the purposes of free, fair, transparent and robust electoral process.

Provision of Model Code of Conduct

  • Shall apply on State and Central Government.
  • Considering the SR Bommai case (1994), that the caretaker government should merely carry on the day-to-day governance and cannot announce any new schemes
  • Use of official resources for any non-official purposes is prohibited for Ministers of the caretaker Government.
  1. Model Code of Conduct will remain in force till completion of the election to constitute the new assembly.
