- The Supreme Court has ordered the immediate release on bail of freelance journalist Prashant Kanojia.
- He was arrested for alleged objectionable comments on Twitter against Chief Minister Yogi Adityanath.
- The SC affirmed that fundamental rights guaranteed under the Constitution of India and in particular Articles 19 and 21 are non-negotiable.
- The SC also clarified that its order of release on bail shouldn’t be equated with the approval of his social media posts.
- The SC was acting on the petition for writ of Habeas Corpus.
- It is a writ requiring a person under arrest to be brought before a judge or into court, especially to secure the person’s release unless lawful grounds are shown for their detention.
- The writ has been guaranteed under Article 32 of the Indian Constitution.
