Work – Ethics for Bureaucrats: An Essay on Law and Values

Views – Rohr argued that public administrators should derive their ethical values from the Constitution rather than relying only on organizational rules.

  • Administrators are not merely rule-followers while exercising discretion, they must uphold constitutional values and democratic principles.

  • Administrative ethics should be rooted in the responsibilities of public office. Personal preferences must not override constitutional obligations.

  • Since modern bureaucracy exercises substantial discretionary power, its legitimacy depends on its constitutional accountability and adherence to democratic values. for e.g. Puttaswamy v. Union of India (2017)

  • Administrative action affecting citizens’ privacy must conform to constitutional values of dignity, and liberty.
