Why in the News?

The Supreme Court has pulled up an Advocate-on-Record (AoR) for filing a frivolous case.

What is Advocate-on-Record (AoR)?

What is it(1) Advocate on record(AOR) is a title given to an advocate who can represent a cause or pleading before the Supreme Court(SC).
(2) Only these advocates are entitled to file any matter or document before the SC.They can also file an appearance or act for a party in the SC.Hence, AOR basically serves as the link between litigants and the highest court in the country.
Note: AORs can also appear before other courts.
Based onAoR system is based on the British model of barristers and solicitors where barristers argue cases and solicitors handle client matters.
Eligibility Criteria to become AORThe Supreme Court Rules, 2013 prescribe eligibility criteria for an AoR:
First, an advocate has to clear an examination set by the Supreme Court and has to meet specific criterias such as:
1.An advocate must undergo training with a court-approved AoR for at least one year before taking the examination.
2.The advocate should have at least four years of legal practice before beginning the training.
3.An AoR must have an office located in Delhi within a 16-kilometer radius of the Supreme Court.
Rules governing AORThe Supreme Court creates the rules for the AoR system based on the authority given to it under Article 145 of the Constitution.
Note: Under Article 145 of the Constitution, the Supreme Court is empowered to make rules and regulate its own procedure for hearing cases.
